Data Privacy Policy of ams OSRAM in Social Media

Our business is based on trust. The protection of personal data (data protection) is a matter of great importance to ams OSRAM. Therefore, we carefully ensure that we observe all applicable data protection laws and continuously strive for even higher levels of data protection.

This document represents the Data Privacy Policy of the social media platforms operated by OSRAM GmbH and its affiliated companies (hereinafter referred to as the “ams OSRAM group”) mentioned below. The contact details of OSRAM GmbH are provided under Paragraph 1. You can also use these contact details to request information on the individuals responsible for the online presence.

These social media buttons only provide the links to the corresponding providers. No data is transmitted to these providers unless you click these buttons. Clicking these buttons takes you to the web site of the corresponding provider. Depending on whether or not you were logged on at the corresponding providers at the time of clicking the respective button, your data will be processed in accordance with the data use policies of these providers and possibly used for profiling, which does not fall within our responsibility.

The ams OSRAM Facebook page is operated by ams OSRAM on the technical platform of Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2 ("Facebook").   
In the paragraphs below, you will find information on the processing of data on the ams OSRAM Facebook page (1.1) and on the information published by Facebook regarding the processing of personal data by Facebook (1.2).

2.1. Processing of data on the ams OSRAM Facebook pages        
If you are registered with Facebook, you can click the “Send message” button to send us a message. These messages cannot be viewed by other Facebook users. We only use the personal data you send with such messages to answer your message. Art. 6 I f GDPR constitutes the legal basis for this processing. The message will be deleted once we have answered your request. For more detailed information on data protection at ams OSRAM, please refer to the OSRAM Data Privacy Policy. This Policy also provides information on your rights regarding the processing of your personal data, as well as options for contacting us on matters of data protection.

In addition, ams OSRAM uses the “Facebook Insights” function which shows statistical information on the use of the ams OSRAM Facebook page made available by Facebook (for more details, refer to 2.2). However, apart from the information on the processing of personal data provided here, ams OSRAM has no influence on the processing of personal data collected when you use the ams OSRAM Facebook site. The responsibility of ams OSRAM is restricted to the collection of the above-mentioned data and its forwarding by way of transfer (see also the court decision by the Court of Justice of the European Union (CJEU), Case: C-40/17 “FashionID”). We would like to expressly point out that you use the ams OSRAM Facebook page and its function under your own responsibility. This especially applies to the use of interactive functions (e.g. commenting, sharing, liking).

2.2. Information provided by Facebook on the processing of personal data
When visiting the ams OSRAM Facebook page, Facebook collects information, especially within the scope of the Insights function, which relates to a visit to, or an interaction with the ams OSRAM Facebook page and its contents. To comply with the requirements set out in the GDPR, Facebook has declared here that the corresponding page operator, i.e. in our case ams OSRAM, and Facebook Ireland are jointly responsible. In addition, this declaration confirms that Facebook Ireland assumes the primary responsibility for the processing of the data in accordance with the GDPR and is also responsible for fulfilling Data Subjects’ rights.

3. Glassdoor

The official ams OSRAM Glassdoor account is:

Glassdoor provides a unique combination of current job posts with millions of employer evaluations, salary information and experience reports from companies in order to make it easier for you as a job seeker to find a job that suits your needs. All this content is shared by those who know a company best – its employees. This means that job seekers using Glassdoor are comprehensively informed of the jobs they apply for and the corresponding companies. Glassdoor serves as an evaluation platform for ams OSRAM. Employees/external candidates can leave anonymous comments about our company on this platform. Users can evaluate both the company itself and the job application process.

3.1. Information provided by ams OSRAM on the processing of personal data

If you send us an anonymous comment via our ams OSRAM Glassdoor page, we never process any personal data about you – unless you have indicated your personal data yourself in your comment/evaluation. In this case, we can use this data in order to send our answer to your comment to you personally. The legal basis for this data processing is Art. 6 (I) (f) GDPR. If you leave an anonymous evaluation of our company or our application process, we will at no time receive/process any personal data about you.

Apart from the processing of personal data described above, ams OSRAM has no influence on the processing of your personal data collected when you use the ams OSRAM Glassdoor account. Please note that you use our Glassdoor account and your function under your own responsibility. This especially applies to the use of interactive functions (e.g. commenting, sharing, liking).

3.2. Information provided by Glassdoor on the processing of personal data

Glassdoor collects data about your person in order to be able to make services available to you. To provide individuals with these services in the best manner possible, the ability to collect and use data is indispensable for Glassdoor. If you are a registered user of the platform, the primary reason why there is a need to collect data is to fulfill contractual duties towards you.

4.  XING/Kununu

The official ams OSRAM XING/Kununu accounts are:

XING is a service which focuses on contributing to improving and simplifying its users’ professional life through a variety of different applications. The combination of these applications provides an optimal user experience and the largest possible scope of functions. With the boundaries between working and private life becoming more and more blurred in today’s world – and in view of the interactions between the two – XING not only focuses on the professional context, but also includes applications intended for private life. In particular, XING aims at opening up new opportunities for (mainly professional, but also private) users, facilitating the building of horizontal networks, democratizing information, promoting the sharing of information, and supporting life-long learning. To fulfill these purposes, XING also provides its users with information, offers, recommendations and services, on the basis of data collected. Furthermore, it promotes interaction – within and outside a user’s network. Applications made available by XING include the social network, for which a user can acquire a membership, an event platform, an employer evaluation platform, as well as a platform for the promotion of employee engagement. Certain XING applications are made available under other brand names or require the use of other XING websites (such as Kununu, HalloFreelancer).

4.1. Information provided by ams OSRAM on the processing of personal data

In order to be able to communicate with you via our ams OSRAM XING pages, we process the following personal data: 

  • Your XING user name, as well as other personal data which you make available to us via your messages/requests. Your messages/requests are not shown to other XING users and will be deleted as soon as they have been answered.
  • Your XING user name, along with other personal data which you leave in your comments on our pages.
  • We also process further information on your activities on our pages (e.g. sharing, linking), data about the scope of interactions, as well as statistics about the age composition and working relations of our visitors, which we can access via the XING statistics service. We also share your contents on our page where appropriate, provided that this function is supported by the social media platform.

Kununu serves as an employer evaluation platform for us. Here you can evaluate our company anonymously. In this context, ams OSRAM does not collect any personal data, unless you disclose your personal data in your comment or evaluation.

Apart from the processing of personal data described above, ams OSRAM has no influence on the processing of personal data in the context of your use of ams OSRAM XING pages. Please note that you use our pages and your function under your own responsibility. This especially applies to the use of interactive functions (e.g. commenting, sharing, liking).

4.2. Information provided by XING/Kununu on the processing of personal data

Data is mainly processed in order to meet contractual obligations towards users. Apart from this, XING/Kununu processes your data for the safeguarding of their legitimate interests while giving due consideration to your own interests (e.g. if we send you advertising newsletters). In certain cases, XING/Kununu is legally obliged to process data (e.g. for the disclosure of data to law enforcement authorities). In all other cases, we seek your separate consent to the processing of your data (e.g. when using tracking technologies for measuring and optimizing the effect of advertising, or within the scope of lotteries/prize draws). In order to fulfill its contractual obligations towards its users, XING/Kununu continuously adapts its products and services to its users’ needs. Personalization plays a major role here. Interest and use profiles are created in this context: In fact, XING/Kununu must understand your interests in order to be able to submit suitable recommendations – such as job posts, events, groups or contacts – or to introduce you to other users as a valuable business contact or potential future employee. To determine these interests, XING/Kununu uses the information which you disclose to it, along with implicit feedback – i.e. information which XING/Kununu obtains automatically when you use its service (via so-called “tracking”), and possibly also information which XING/Kununu obtains indirectly (e.g. via a user’s address book or a list upload). Furthermore, within the scope of contract performance, XING/Kununu sends you third-party advertising which suits your interests and needs in the best possible manner. For this purpose, it makes certain targeting criteria available to advertisers.

Any contents or opinions from accounts other than those mentioned above are the responsibility of the corresponding author and do not reflect the opinion of ams OSRAM. ams OSRAM does not assume liability for these third-party contents. Since social media posts can contain links, please note that ams OSRAM is not responsible for the contents published on websites which are not operated by us. In addition, ams OSRAM cannot be held liable for the correctness and completeness of all the information provided on the social media channels of ams OSRAM. 
Our social media activities are aligned with our working hours.         

5.1. Processing of personal data on social media platforms by ams OSRAM    
The data which you enter on a social media platform – such as comments, videos, pictures, likes, public messages, etc. – are published by the social media platform. We do not use this data for any other purposes at any time, but only reserve the right to delete content if necessary (see the “ams OSRAM Netiquette for Social Media Platforms”). As appropriate, we share your contents on our page, provided that this function is supported by the social media platform, and we communicate with you via this platform. The legal basis for the processing is Art. 6 Paragraph 1 S. 1 lit. f GDPR. We process this data in the interest of our public relations work and communication.

If you would like to object to a certain type of data processing under our influence, please use our contact details in the Legal Notice. Afterwards, we will verify your objection.

If you submit a request to us via the social media platform, it depends on the answer you require whether we refer you to other, secure communication paths which guarantee confidentiality. In addition, you can always use the address mentioned in the Legal Notice in order to submit confidential information to us.

Please note that we only have limited influence on the statistics made available to us by the social media platform provider, and that we are not able to turn them off. We do not, however, request them from the platform.

5.2. Processing of personal data on social media platforms by the corresponding social media providers     
Social media platforms use web tracking methods. Web tracking can also be independent of whether or not you are logged on to, or registered with the social media platform. We cannot influence the web tracking methods of social media platforms. For example, we cannot turn them off. The responsibility of ams OSRAM is restricted to the collection of the above-mentioned data and its forwarding by way of transfer (see also the court decision by the Court of Justice of the European Union (CJEU), Case: C-40/17 “FashionID”).

We would like to expressly point out that it cannot be excluded that the social media platform provider uses your profile and behavior data in order to evaluate your habits, personal relationships, preferences, etc. For more detailed information on data processing by the social media platform provider and further  options to object to this processing, please refer to the Data Privacy Policy of the corresponding provider:

6. Onward transfer of personal data

For the purposes mentioned above, ams OSRAM can transmit personal data to other OSRAM group companies, provided that this is necessary for the fulfillment of these purposes.

ams OSRAM may transfer personal data to courts, supervisory authorities or law companies – to the extent legally permissible and required in order to comply with applicable law or to assert, exercise, or defend legal claims.

If required, ams OSRAM cooperates with service providers (so-called Processors), such as IT maintenance service providers. These providers only become active if instructed to do so by ams OSRAM and are contractually obliged to comply with all applicable data protection requirements. These data recipients can be located in a country outside the European Economic Area (“third countries”) in which the applicable law does not guarantee the same level of data protection as in your home country. Should this be the case, ams OSRAM takes measures in order to provide other suitable and appropriate guarantees for the protection of personal data, for example through our Binding Corporate Rules (“BCR”) on the protection of personal data or the EU Standard Clauses.

7. Storage of your data

If no data storage period has been indicated upon data collection, we will erase your personal data if (i) it is no longer required in order to comply with the original purpose of storage, and provided that (ii) no legal retention periods (e.g. answering of your messages/requests) and (ii) no legal retention periods (e.g. under trade or fiscal law) require a longer storage term for your data.

8. Your rights as a Data Subject
You have the following rights with regard to the processing of your personal data by ams OSRAM:

  • in accordance with Art. 15 GDPR: Data Subject’s Right of Access
  • in accordance with Art. 16 GDPR: Right to Rectification
  • in accordance with Art. 17 GDPR: Right to Erasure (‘Right to Be Forgotten’)
  • in accordance with Art. 18 GDPR: Right to Restriction of Processing
  • in accordance with Art. 20 GDPR: Right to Data Portability

Right to object in accordance with Art. 21 GDPR:    
If we process your data on the basis of legitimate interests (Art. 6 (1) (f) GDPR – “Lawfulness of the Processing”) or for compliance with a legal obligation to which we are subject (Art. 6 (1) (e) GDPR) – and in case that our legitimate interests are overridden by the Data Subject’s (contact partner’s) special situation which requires protection of personal data – you have the right to object to the processing in accordance with Art. 21 (1) GDPR.

In addition, you have the option of submitting a request to, or lodging a complaint with the competent data protection authority at any time.

The rights of the contact partner as a Data Subject only apply to the extent that they are compatible with the underlying business relationship with our business partner.
